Governance

The governance structure of the EUROCONTROL organisation is composed of two governing bodies, the EUROCONTROL Commission and the Provisional Council, and an executive body: the Agency.

The organisation involves a wide-range of stakeholders in its decision-making process.

Governing bodies

The decision making at political and institutional level takes place with:

EUROCONTROL Permanent Commission

The EUROCONTROL Permanent Commission represents Member States at ministerial level. It formulates general policy and is responsible for decisions and regulatory functions. The Commission also approves the EUROCONTROL annual budget, the five-year programme, contract regulations, financial regulations and staff regulations, and is responsible for appointing the Director General and Directors. It gives a final ruling on the Agency’s annual accounts. Permanent Commission

EUROCONTROL Provisional Council

Member States are represented in the Provisional Council at Director General of Civil Aviation level. The European Union participates in the work of the Provisional Council. The Provisional Council is responsible for implementing EUROCONTROL’s general policy, as established by the Permanent Commission, and for supervising the Agency’s work.

EUROCONTROL’s institutional structure includes a number of advisory bodies to the Provisional Council and/or to the Commission that monitor the transparency of the Agency’s work, supervise operations in specific areas, facilitate dialogue and coordinate work programmes in certain domains. Executive body

The EUROCONTROL Agency is responsible for performing tasks prescribed by the Convention or entrusted to it by the Permanent Commission or the Provisional Council. 

Under the revised Convention, the Director General was given wide independence with regard to the management of the Agency.

Functional and operational level tasks fall under this category, e.g., the Network Manager function.

Advisory bodies

There are different consultation bodies dedicated to specific work areas:

The Audit Board

The Audit Board reports to the EUROCONTROL Permanent Commission through the Provisional Council. It is composed of six members designated by six Contracting States on a rotating basis for a term of office of four years. Half the Members are renewed every two years. They must be professional auditors and are reimbursed for their travel expenses. The Audit Board organises its work independently. It:

  • examines and certifies annually the financial statements of the Agency and of the EUROCONTROL Pension Fund, and the balance sheet and administrative account of the Route Charges System;
  • reports to the Permanent Commission concerning the level of transparency of the Agency's procedures and decisions;
  • assesses complaints by Member States in the field of procedures and reports to the Permanent Commission.

Performance Review Commission

The Performance Review Commission (PRC) supports the effective management of European air traffic management (ATM) through the establishment of a transparent and independent performance review system.

The PRC reports to the EUROCONTROL Commission through the Provisional Council on all matters relating to the performance review of air traffic management. To fulfil these functions the PRC is supported by the Performance Review Unit (PRU) of EUROCONTROL's Directorate Pan-European Single Sky (DPS). (More)

Agency Advisory Body

Replacing and combining the former Stakeholder Consultation Group (SCG) and the Operational Consultation Group (OCG), the Agency Advisory Body (AAB) is an advisory body to the EUROCONTROL Director General.

It provides a broad range of balanced advice together with the widest possible stakeholder support and commitment in matters relating to the European ATM strategic objectives of the Provisional Council and the operation of the European ATM network as set out in the Agency Business Plan.

Operating jointly with the Civil-Military Interface Standing Committee (CMIC), the AAB provides a forum within which civil/military coordination can be performed. The AAB therefore advises the EUROCONTROL Director General on the operational and technical matters affecting the European civil and military air transport as a whole while ensuring complementarities with other existing European bodies and avoiding duplication to the maximum extent possible.

In support of the Agency Advisory Body (AAB) and managed by it, there is also a technical expert consultation layer, established around Teams.

Safety Regulation Commission

The Safety Regulation Commission (SRC) ensures consistent high levels of safety in air traffic management (ATM) within the ECAC area.

It is responsible for the development of harmonised safety regulatory objectives and requirements for the European air traffic management system, which are implemented and enforced by EUROCONTROL’s Member States.

The SRC reports to the EUROCONTROL Commission through the Provisional Council on all matters relating to the safety regulation of air traffic management. To fulfil these functions the SRC is supported by the Safety Regulation Unit (SRU) (More).

 

Civil-military Interface Standing Committee (CMIC)

The Civil-Military Interface Standing Committee (CMIC) reports to the EUROCONTROL Provisional Council. It examines questions regarding the civil-military interface and provides advice on such matters. With its high-level civil and military officials from Member States, the CMIC helps to ensure that the requirements of civil and military users of ATM/CNS are met in a balanced way, while paying due regard to national security and defence interests as defined politically (More).

 

Military ATM Board

The Military Air Traffic Management Board (MAB) reports to the EUROCONTROL Provisional Council and provides advice to the Director General. It also coordinates the involvement of military State authorities in the ATM planning and decision-making processes, to the best advantage of the civil-military ATM Performance Partnership.

As the military focal point for ATM/CNS matters, the MAB develops harmonised and State-agreed European military positions as a basis for further civil-military coordination within the CMIC and for the benefit of other relevant European organisations/institutions (e.g. European Union/European Commission, European Defence Agency, European Aviation Safety Agency and the SESAR Joint Undertaking).

Enlarged Committee for Route Charges

The Enlarged Committee for Route Charges supervises the operation of the route charges system and reports to the EUROCONTROL Commission via the Provisional Council.

All EUROCONTROL Member States are represented, and user organisations as well as the European Commission have observer status.

Standing Committee on Finance

The Standing Committee on Finance is an expert committee of the Provisional Council, to which it provides advice and submits recommendations on all budgetary and financial issues affecting EUROCONTROL.

Air Navigation Services Board

The Air Navigation Services Board is made up of representatives of air navigation services providers, airspace users and airports from EUROCONTROL Member States. It is designed to increase the involvement of air navigation stakeholders in preparing decisions and in aligning the business planning and budgetary processes at different levels in the organisation, while respecting the decision-making responsibilities of the Member States.

Besides its former advisory role, it is empowered to endorse Agency’s Strategy and Business Plan and associated financial commitments.

Agency Research Team

The EUROCONTROL Agency Research Team is a forum for exchange to support awareness between the different interested parties, including the identification of complementarities, duplication of work and gaps requiring further coordination and actions when appropriate.

ART organises two workshops annually on specific topics selected by ART for their potential impact on ATM and ATM research (more).

Internal Audit

EUROCONTROL’s Internal Audit Unit helps senior management oversee an effective system of internal controls designed to help the Agency meet its objectives. Internal Audit’s scope includes the assessment of controls to ensure the:

  • reliability and integrity of financial and operational information.
  • effectiveness and efficiency of operations and programmes.
  • safeguarding of assets (including the Pension Fund)
  • compliance with laws, regulations, policies, procedures and contracts
  • effective Risk Management processes.

The Head of Internal Audit, whose appointment is approved by the Provisional Council and the enlarged Committee for Route Charges, reports directly to the Director General. She may bring matters which in her view are significant to the attention of the Audit Board, the Provisional Council and the enlarged Committee.

 

Other boards

The Network Manager Board

The Network Management Board (NMB), created as part of the European Commission Regulation (EU) No 677/2011 of 7 July 2011, is the new governing body of the Network function. The NMB, inter alia, endorses the Network Strategy Plan including its annual strategic objectives and the NM Performance Plan (NM-PP), approves the annual Network Operations Plans (NOP) and the network annual report.

The NMB focuses on monitoring the activities related to the management of the network functions, the Network Manager activities related to network crisis, the progress on the implementation of the agreed plans, and this to include high-level operational consultation.

The NMB addresses matters that cannot be resolved at the local network function level. It therefore handles all relevant network issues and acts exclusively to improve the performance of the European network.

The Network Manager exercises its functions in close coordination with the Enhanced Directors of Operations Panel to prepare the NOP and NM PP.

Maastricht Coordination Group

The Maastricht Coordination Group was set up in November 1986 by Belgium, Germany, Luxembourg and the Netherlands to determine a common position regarding all matters relating to the operation of the air traffic services provided by the Maastricht Upper Area Control Centre.

It consists of high-level civil and military representatives of the four States. It reports to the Committee of Management in the first instance.

 

Legal framework

EUROCONTROL is a civil-military intergovernmental organisation with Member States across the European continent. It is governed by an international convention.

Original EUROCONTROL Convention

The Organisation was established through the EUROCONTROL International Convention relating to Co-operation for the Safety of Air Navigation signed at Brussels on 13 December 1960 which entered into force on 1 March 1963.

Two Protocols were signed in Brussels on 6 July 1970 and 21 November 1978 relating to tax issues and are still in force today (as amended by Article XXXVIII of the amending Protocol of 1981).

Amended EUROCONTROL Convention and Multilateral Agreement relating to Route Charges

In order to align the EUROCONTROL functions with the expectations of its members, the Protocol amending the EUROCONTROL Convention of 1960 (the "Amended Convention") as well as a Multilateral Agreement relating to Route Charges were signed in Brussels on 12 February 1981 and entered into force on 1 January 1986. Both instruments are still in force today.

Revised EUROCONTROL Convention

On 27 June 1997 in Brussels, 27 EUROCONTROL Member States signed the Protocol consolidating the EUROCONTROL Convention (the "Revised Convention"). The ratification process of the Revised Convention is currently ongoing, but the EUROCONTROL Member States agreed in December 1997 on the early implementation of some of the provisions contained in the revised Convention.

Accession of the European Union

On 8 October 2002, in Brussels, EUROCONTROL Member States and the European Community signed a Protocol on the Accession of the European Community to the EUROCONTROL Convention which is now in the process of being ratified by the European Union and the EUROCONTROL Member States. The EUROCONTROL Member States and the European Community decided in 2003 to provisionally apply, pending their entry into force, certain provisions of the Protocol on the Accession of the European Community to the revised Convention.
