Legal requirements (SES)
One of the European Commission’s main priorities is to connect the technological pillar of the Single European Sky (SESAR) with the performance scheme; in other words: technology deployment should be decided if and only if such deployment brings demonstrated performance gains at network or at least local level, and/or contributes to the defragmentation of service provision and economies of scale.
To ensure this, the Commission wants to monitor the main ANSP investments, check whether they are materialised according to budget and schedule, and assess their consistency with SESAR deliverables.
In line with this approach - and on the basis of the new performance and charging regulations -, in 2012, the European Commission asked for the PRB’s assistance in monitoring the ANSP’s investment policies and their connection to the ATM MP.
Member States’ reporting obligations on CAPEX/investments are based on Articles 3(3)(i) and 18(4) of the performance Regulation (EU) No 390/2013. However, during RP1 (2012-2013-2014), the assessment of investment/CAPEX is carried out against the RP1 performance plans, adopted under the regime of Regulation (EU) No 691/2010 (the initial performance Regulation), where transparency on investment was less demanding. RP1 is therefore a transitional period and is to be used as a learning exercise towards the accurate and detailed reporting that will be requested as of 2015.
Substantial preparatory work has been carried out by our CAPEX team, resulting in the preparation of a report template pre-filled with the data from the RP1 performance plans and actual data and information submitted by States. This template is meant to facilitate the NSA’s fulfilment of their reporting obligations.
For the last three years, our team has been involved in
- assessing the Capital Expenditure (CAPEX) information provided by the ANSPs in their annual performance monitoring reports: RP1 (2012-2014) Monitoring Reports;
- and their Performance Plans: RP2 (2015-2019) Performance Plan Assessments
